Terms and Conditions — Public Summary

This is the public summary of TimelyStay's Terms and Conditions. The binding individual contract is presented and digitally accepted by each Owner in the client area after sign-up, and prevails in case of conflict.


1. About TimelyStay

TimelyStay is a Portuguese company (Via Globe Unipessoal Lda) providing professional services for short-term tourist accommodation (Alojamento Local), condominium management, long-term rental, and property setup / decoration.

Headquartered at Rua de Santo Amaro 17A, Loja 8, Lisbon. Contracts entered into by TimelyStay are governed by Portuguese law, with venue in the Court District of Lisbon.

2. Services offered

Subject to a written contract digitally accepted, TimelyStay offers:

  • Short-term Alojamento Local management on platforms such as Airbnb, Booking.com, Expedia and similar.
  • Condominium management.
  • Long-term rental management.
  • Decoration, setup, and preparation of properties for tourist operation.

3. Pricing and revenue share

The Owner's compensation is a percentage of the net booking revenue (after deducting platform fees and taxes), with TimelyStay retaining the complementary percentage as a management fee.

The percentages, optional services (maintenance, tourist tax submission, linen) and any additional charges applicable to each Owner are set out in the individual contract available in the client area.

Cleaning fees are charged directly to guests by the booking platform and retained by TimelyStay as remuneration for the cleaning service; they are not part of the shared revenue.

4. Individual contract and digital acceptance

The binding contract between TimelyStay and each Owner is the individual contract presented in the client area, digitally accepted under Regulation (EU) 910/2014 (eIDAS) and Portuguese Decree-Law 12/2021.

Sign-up and subsequent use of the platform — including login and access to the client area — entail knowledge and acceptance of these Terms and the applicable individual contract, under articles 217 and 234 of the Portuguese Civil Code.

Each new version of the contract is presented in the client area and requires timely digital acceptance.

Contractually relevant information — including bookings, amounts, settlements and tax documents — is made available to the Owner permanently and accessibly in the client area.

5. Main Owner obligations

Maintain a valid AL (Alojamento Local) licence (Decree-Law 128/2014 as amended).

Maintain adequate multi-risk and third-party liability insurance.

Keep the property, furniture, and equipment in condition suitable for tourist operation.

Submit tourist taxes and guest identification data to the competent authorities (SEF/AIMA, Municipal Council, Turismo de Portugal), unless the corresponding optional service is contracted — the Owner remains the principal obligor before the authorities in any case.

6. Communications

Communications between TimelyStay and the Owner (Cedente) are conducted EXCLUSIVELY through the client area of the TimelyStay.com platform — including the "Communications", "Formal Notices" and other applicable tabs — designated as conventional domicile under article 224 of the Portuguese Civil Code.

Any communication made available in the client area is, for all legal purposes, a valid received notification. Registered mail, email, instant messaging (including WhatsApp) or other channels, when used, are merely informative and courteous, producing no autonomous contractual effects (clause 33(vii) of the individual contract).

It is the Owner's obligation to access the client area regularly — at least once per civil month — to consult the contractual and fiscal documents made available there.

7. Privacy and data protection

TimelyStay's processing of personal data fully complies with Regulation (EU) 2016/679 (GDPR), Portuguese Law 58/2019, Decree-Law 28/2019 (electronic invoicing) and other applicable legislation.

Legal bases for processing include: (a) contract performance (art. 6(1)(b) GDPR); (b) compliance with legal obligations applicable to Local Accommodation, invoicing and tax matters (art. 6(1)(c) GDPR); and (c) TimelyStay's legitimate interest (art. 6(1)(f) GDPR) for platform security, fraud prevention and defense of contractual rights in judicial or extrajudicial proceedings.

The Owner expressly consents, under Decree-Law 28/2019 and Ordinance 195/2020, to the EXCLUSIVELY electronic delivery, through the client area, of invoices, receipts, debit notes and other fiscal documents.

Platform access data (IP, user-agent, session date and time) is retained under TimelyStay's legitimate interest and may be used as proof of access and contractual ratification, under clause 33(vii) of the individual contract.

8. Liability

TimelyStay acts as a service provider. Its management, supervision, and diligence obligations are obligations of means, not of result, measured by the reasonable conduct of an average operator of the Alojamento Local sector in comparable circumstances.

The Owner, as holder of the property and the AL licence, is the entrepreneur of the business and primary economic beneficiary; risks inherent to ownership remain with the Owner (including property damage, guest disputes, tax and regulatory charges).

9. Governing law and venue

These Terms and the individual contract with each Owner are governed by Portuguese law.

Disputes shall be resolved before the courts of the Lisbon Court District, without prejudice to mandatory rights granted to consumers.
